The answer is Yes you can switch to new employer. Your H-1 does not matter anymore as you have applied for AOS and you have a valid EAD which you can use for AC21 portability for a new employer after 180 days.

I do not get my pay checks by email. We have to log into our company's internal web site and take a print out of the paycheck. (Its actually a web page I have been taking a printout, even for my Visa extensions). My parents had a Visa Stamping last month with out any issues.

Hello,
My labor certification was filed in December '07 and is in the process of audit (Fragomen law firm issue). Meanwhile, there is news that my company is being sold off. Will I be able to continue my GC process if the company gets sold off but I am able to retain the same job and title.
Is anyone else facing a similar situation? What are my options here?

My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:
1. I have heard that it takes long time to get K3 visa, is that true?
Yes it is true that the K3 visa may take a year and the spouse must remain in the home country during that time.
2. If the above statement is true then what other visa option is best for her, visitor or fiance visa (K1 visa)?
She can try for K1 visa but it must be filed now and she must come to the US before marriage. The K1 visa processing can take a few months so your cousin may be running out of time.
3. Is it necessary that immigrant visa petition (greencard) is in process before applying for K3 visa?
The K3 is the greencard process and it can only be filed after the marriage has occurred.

"Copy of visa page of passport in color " is listed as one of the supporting docs for ead renewal.(in the IV thread on EAD self filing)
Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.
I had the same question so i spoke to my lawyer/attorney
she said that it is not necessary
infact in intial eveidence
1) copy of passport or DL or Visa Page or some national Id with picture
2) color photos
3) copy of 485 recipt or EAD
She said most of the attornies/lawyers are asking for extra documentations so that to pre-empt RFEs but she asked me to file with intial evidence that is asked on the instruction form i.e the three items i mentioned above.
I filed with those if they require additional evidence i will comply.

Hi. I just e-filed my I-539, status of change request from F-1 to H-4. I just found out that I chose "North Korea" for my citizenship, while it was supposed to be "South Korea". I chose "South Korea" for the passport issuance country.
How can I fix this? Should I attach a letter explaining this, when sending the supporting documents? What else supporting documents should I submit, other than my husband(H-1)'s paystub, I-129 approval notice and our marriage certificate?

you need to write a covering letter describing your mistake and mention all the supporting documents
Supporting documents can be
1. your passport
2. your husband passport with your name mentioned on it
3. your birth certificate
4. your educational certificate (if it specifies your country of birth)
I would suggest to send at least two or three supporting documents which shows your date of birth.
In fact I did the same problem and I had to send the supporting documents.

Thanks fromnaija, If she maintains any non-immigrant visa she can be added without any 'follow-to-join' petetion right i.e., she can be added to my 485 just like the normal process when my PD becomes current.

My attorney filed for H1B extension.
Unfortunately, by mistake LCA stating dates from 07/31/2007 to 07/30/2010.
but I am only qualify upto 06/30/2010 as per 6 year H1B limit.
Atty, told me that 1-129 going to file upto 06/30/2010.
Is it o.k.

You can file an amendment. Mistakes is so common at USCIS.
If you dont want to, I think you can recapture your unused time on h1b and get h1b for extended period based on time not in the US. Check with attorney and see if you can get h1b extension for all the time you were not in US.

I have applied 485 in July 2, 2007. Note that my PD Jan 2001 - EB3 (priority dated ported) And I140 is already approved. I have done FP in Oct 2007. Received EAD and AP way back.But I saw LUD on my 485 application on Dec 14, 2007.
Does this mean any thing. Message content is not changed though.

How much time did the attorney ask for on the I-129 and LCA? If either is just one year, then there's no basis for appeal. CIS did nothing wrong.

is it absolutely safe to travel with pending i 485 app with valid h1b stamping with receipt notice and completed fp.?we are kind of confuded whether to plan for the travel...We have not yet received the actual advance parole. i read somwhere that if u leave the country wth pending i 485 but without ap ur appl is considered abandoned.is this true.?..we have the option to change the trip to apr too.In a nutshell is it completely safe to travel on 485 pending appl without ap with valid stamping.?:confused:

Whats your PD? If you are on H1, have a stamping and already have the 485 receipt, the only possible issue with travel is if your 485 gets approved when you are abroad. People have still managed to enter on H1 as PoE officer apparently does not realize about your 485 approval.
If its a recent PD, then no issues, you can travel (Actually my lawyer told me I can travel even without getting the 485 receipt, but thats apparently a bit of a grey area)

I am currently on H1 Visa in the US. Am I allowed to go to school part-time and get my MBA degree ?
And also, I am looking at a big amount of money that I gotta pay for tuition, does anyone know any tax credits that we can use to reduce the burden ?

Yes, you can do part-time MBA without issues. There are tax breaks both at the federal and possibly the state level (NY has a tax break for students). The tax software will guide you thru it.
